- Definition of Basic Terms
For the purposes of these Operating Rules, the following terms shall have the following meaning:- Price List - the current overview of prices of Services, Supplementary Services, and Goods provided by the Provider, available to the Client on the Provider's Website or at the Facility.
- Gift Voucher — a voucher that the Client may use to purchase Credit in the form of a Single Entry or a Class Package, or to purchase Goods.
- Supplementary Services — services provided by the Provider in addition to the Services, according to the Provider's current offer.
- Single entry — credit for one entry to a Service or Supplementary Service, paid by the Client to the Provider.
- Client — a natural person over the age of 15 who uses the Services or Supplementary Services provided by the Provider at the Facility or through the Provider's Website.

- Credit package — funds credited to the Client's account after payment to the Provider, which the Client uses to pay for Services, Supplementary Services, or Goods according to the Provider's Price List (also referred to as “Credit”).
- Instructor — a person with appropriate qualifications who conducts individual or group Services.
- Class Package — Credit for multiple entries purchased by the Client according to the Provider's current offer, which the Client is entitled to use for Services or Supplementary Services.
- Payment Gateway — the payment gateway operated by Stripe under the service called “Stripe”, which allows the Client to purchase Credit or a Gift Voucher via the Registration and Reservation System available on the Website. A detailed specification of payment conditions and methods provided by the Stripe service is regulated in the Stripe Terms and Conditions.
- Facility — the sports facility under the name FORMERY, located at: Strojárenská 9, 040 01 Košice (also referred to as “Studio”).
- Operating Hours — the time during which the Client may use Services or Supplementary Services at the Facility or purchase Goods. The Operating Hours are published on the Provider's Website.
- Provider — the company pilco. s.r.o., registered office: Námestie Osloboditeľov 3/A, 040 01 Košice, Slovak Republic, Company ID: 56 839 677, Tax ID: 2122461550, VAT ID: SK2122461550, registered in the Commercial Register of the Municipal Court Košice, Section: Sro, File no. 61826/V, which operates the sports facility.
- Operating rules — rules regulating the rights and obligations of the Client and the Provider, setting the conditions for the provision of Services and Supplementary Services by the Provider and the conditions for the operation and use of the Facility. The Operating Rules are displayed in a visible place at the Facility and on the Website.
- Registration and Reservation System — an online system accessible through the Website, allowing the Client to register and book a Service or Supplementary Service with the Provider and make payments for reservations via the Website.
- Complaints Procedure — rules regulating the manner of asserting the Client’s claims arising from the Provider’s liability for deficiencies and defects of the provided Service or Supplementary Service and the manner and procedure for handling complaints.
- Services — services provided by the Provider at the Facility within its business activity, consisting mainly of sports activities carried out as individual or group sessions under the professional guidance of the Instructor, in particular: pilates on mats and pilates on reformers, according to the Provider's current offer (also referred to as “Classes” or “Lessons”).
- Studio - premises intended for sports activities, organizing sports, cultural, and other social events.
- Merchandise — goods offered by the Provider to Clients or other persons, especially clothing and accessories, according to the Provider's current offer.
- Terms and Conditions — available at the Provider's Facility and on the Website, regulations of the mutual rights and obligations between the Provider and the Client when using Services at the Facility or through the Website, and regulating other legal relations related to the Provider and the Client (also referred to as “T&C”).
- Force Majeure — a legal event consisting of extraordinary, unforeseeable, unavoidable, and unintentional circumstances, in particular natural disasters, natural catastrophes, armed conflicts, rebellion, revolutions, uprisings, strikes, fire, explosion, earthquake, flood, lightning strikes, storms, calamities, pandemics, etc.a legal event consisting of an extraordinary, unpredictable, unavoidable and innocent event, in particular natural events, natural disasters, war conflicts, rebellion, revolution, insurrection, strike, fire, explosion, earthquake, flood, lightning strikes, storms, calamities, pandemics and the like.
- Website — the website www.formery.studio, containing current information on the Facility’s activities, Services, Supplementary Services, Goods, Operating Hours, T&C, Operating Rules, Complaints Procedure, and other information for Clients.
- Waitlist — a list of Clients who are interested in attending a fully booked Service or Supplementary Service and will be automatically notified in case of an available spot.a list of Clients who are interested in participating in a fully occupied Service or Additional Service and will be automatically informed in case of vacancy.
- Responsible Person — an employee of the Provider authorized to inform Clients about Services, Supplementary Services, and Goods, to receive and handle complaints, to monitor compliance with the Operating Rules, and to perform other activities related to the operation of the Facility. The actions of the Responsible Person shall be deemed to be the actions of the Provider.
- Purpose and scope
- These Operating Rules (hereinafter referred to as the “Operating Rules”) regulate the rules, conditions, and principles of safe and efficient use of the Services at the Formery Facility, operated by the company pilco. s.r.o., registered office: Námestie Osloboditeľov 3/A, 040 01 Košice, Slovak Republic, Company ID: 56 839 677, Tax ID: 2122461550, VAT ID: SK2122461550, registered in the Commercial Register of the Municipal Court Košice, Section: Sro, File no. 61826/V (hereinafter referred to as the “Provider”) by Clients. These Operating Rules are binding for all persons entering the Studio and are available at the Facility and on the Provider's Website.
- The purpose of the Operating Rules is to ensure safe, comfortable, and hygienic conditions for the provision of Services and Supplementary Services to Clients.
- The persons responsible for the Facility are Michaela Zubárová and Denisa Petrová, managing directors of the Provider.
- Facility and equipment
- The Facility is open according to the schedule published on the Provider's Website.
- The Facility includes: changing rooms, showers, toilets, exercise areas, towels, basic cosmetics, filtered water, and hairdryers.
- The Client is obliged to use the Facility's equipment and devices solely in accordance with their purpose and staff instructions.
- The Client must arrive at the class in clean and appropriate sportswear that allows free movement.
- Non-slip socks are mandatory for reformer classes. The Client may also purchase them at the Studio.
- The Client must remove jewelry (especially rings, bracelets, watches) before entering the exercise area to avoid damaging the equipment and for their own safety.
- The Client must maintain order and cleanliness in the Studio and return borrowed equipment to its designated place after the class.
- Sanitary facilities (WC, showers) are intended exclusively for Clients who have booked a Service or Supplementary Service.
- Personal belongings must be stored in designated places. The Provider is not liable for loss or damage to personal belongings.
- Entry and Registration
- Entry to the Studio is allowed only to registered Clients who have a valid reservation for a Service through the Registration and Reservation System.
- For reservation purposes, the Client must create an account in the Registration and Reservation System. Creating an account is a condition for attending a class.
- Each Client may reserve only one spot per class. Services are non-transferable.
- The Studio opens 15 minutes before the start of the Service and closes after it ends.
- The Client must arrive on time, no later than 5 minutes before the start of the Service.
- The Client must check in with staff or the Instructor before the start of the Service.
- Persons under 15 years of age are not allowed to use Services or Supplementary Services.
- Reservations, Cancellation and Credit
- Reservations can be made via the Registration and Reservation System up to 2 weeks in advance.
- The Client may cancel their reservation:
- more than 12 hours before the start of the Service – the full amount of Credit will be refunded to the Client,
- less than 12 hours before the start of the Service – the Credit will be forfeited.
- Classes and Credit are non-transferable and non-refundable and must be used within their validity period.
- The Provider reserves the right to cancel a class for technical, staffing, or operational reasons.
- In case of class cancellation, the Client is entitled to a refund of the full Credit used for the reservation, or may reserve another available class.
- Changes to the schedule will be published in the Registration and Reservation System and announced by email.
- Disinfection, Cleaning and Maintenance
- Cleaning of the Facility is performed daily before opening and as needed throughout the day. Sanitary equipment, surfaces, and floors are cleaned as required. Waste bins are emptied as necessary.
- The Provider ensures:
- demonstrable regular cleaning of all premises,
- regular ventilation and disinfection,
- maintenance and disinfection of sports equipment,
- regular replenishment of hygiene supplies.
- Health Condition and Safety
- The Client must be physically and medically fit to attend a class. In case of any health restrictions, acute or chronic diseases, the Client must consult their participation with their physician.
- Studio Instructors do not hold qualifications in specialized training for persons with disabilities and are not authorized to provide individual medical-rehabilitation guidance. Therefore, the Provider reserves the right to refuse to provide Services to persons with disabilities or persons with significant physical, mental, or other specific needs requiring supervision beyond the normal course of a group Class.
- Pregnant Clients are advised to attend classes intended for pregnant women, led by Instructors trained in prenatal pilates.
- The Client exercises at their own risk and the Provider is not liable for injuries caused by non-compliance with instructions or the Client’s health condition.
- The Client acknowledges that in case of violating recommendations for class selection, the Provider is not liable for resulting complications.
- Accidents and First Aid
- In case of injury or health difficulties during a class, the Client must immediately inform the Instructor.
- The Instructor or Responsible Person will provide basic first aid and, if necessary, call professional medical assistance.
- Each injury will be recorded in the accident register maintained by the Provider.
- The contact point in case of emergency is the Studio reception.
- Rights and Obligations of Clients
- The client has the right to:
- to a safe and hygienic environment during the Service,
- to information about the content, difficulty, and course of the Service,
- to correct, professional, and respectful treatment by staff,
- to file a Complaint and have it properly handled according to the Complaints Procedure.
- The client has the obligation to:
- to comply with the Operating Rules and T&C,
- to follow the Instructor’s instructions,
- to act so as not to disrupt the Service or endanger themselves or others,
- to behave politely, considerately, and respectfully towards other Clients and staff,
- to protect the Provider’s property from damage, destruction, or pollution.
- Violation of these rules may be grounds for excluding the Client from the Facility without compensation.
- Rights and Obligations of the Provider
- The Provider has the right:
- to adjust the schedule or replace the Instructor according to operational needs,
- to exclude a Client from the Facility in case of serious or repeated violations of the rules,
- to take measures to ensure safety and protect property.
- The Provider has the obligation:
- to provide qualified Instructors and professional guidance of Services,
- to maintain cleanliness and safety of the premises,
- to provide current and accurate information about Services,
- to ensure the accessibility of the T&C and these Operating Rules at the Facility and on the Website.
- Final provisions
- The layout of the Facility forms Annex no. 1 to these Operating Rules.
- These Operating Rules take effect on the date of their publication and are binding for all Clients from the moment of entering the Facility. The Provider reserves the right to amend or supplement them. All changes will be duly communicated to Clients via the Website or directly at the Facility.
These Operating Rules are valid and effective from 23.06.2025.
